The Supreme Court of the RS issued a verdict in which it fully accepted the claim of the plaintiff and the demands of students and parents of Bosniak nationality from Vrbanjci, Kotor-Varoš , that is, students who attended the “Sveti Sava” Elementary School in Kotor-Varoš.
Lawyer Haris Kaniža , who led this case, confirmed to the media that the Supreme Court “undoubtedly and indisputably established that Bosniak children were discriminated against, that they were entitled to a national group of cases and that they were treated unequally compared to other children in the RS.”
Therefore, the Supreme Court of the RS ordered that the defendant school introduce a national group of subjects – Bosnian Language and Literature, Nature and Society, History, Geography , and that these subjects be taught according to the Bosnian curriculum from the Zenica-Doboj Canton in the FBiH, since that canton is geographically closest to Kotor-Varoš.
The judgment is final and the defendants are obliged to comply with it.
“The verdict of the Supreme Court of the Bosnian entity of RS represents a glimmer of hope in the establishment and functioning of a system that will protect human rights and freedoms,” emphasized RS Vice President Ramiz Salkić.
He believes that it would have been much better if the Supreme Court of the Bosnian entity of RS had made such a decision in its original decision on the same matter.
“That would be an even greater success. In this way, the impression remains that the entity Supreme Court issued the verdict based on a kind of pressure and an earlier decision by the Constitutional Court of Bosnia and Herzegovina,” he pointed out.
In any case, he says, this decision is to be commended and it shows the way to exercise rights and end the systemic discrimination carried out by the authorities of this entity, not only in the educational process, but also in other areas where the rights of citizens are threatened by the authorities.
“We expect the authorities in this entity to implement this decision and, on its basis, end systemic discrimination in all other schools in the BiH entity of RS, so as not to expose other disenfranchised citizens and their children to lengthy court processes,” said Salkić.
He also pointed out that the verdict, which is one of the most important in recent years, is of enormous significance, because the Supreme Court determined that the children in Vrbanjci were discriminated against, and that they were entitled to an ethnic group of cases.
Also, it is a great encouragement that, as he says, the courts, especially the courts in BiH. to the entity of the RS, started passing judgments when it comes to systemic discrimination, which he has been constantly warning about for the past few years.
