A NEW IMPORTANT LEGAL VICTORY FOR BOSNIA AND HERZEGOVINA

As announced by the member of the Presidency of BiH, Dr. Denis Bećirović, he is taking all available legal actions with the aim of respecting and consistently implementing the principles of constitutionality and legality in Bosnia and Herzegovina.
The Constitutional Court of BiH today, deciding on the request of the Member of the Presidency of BiH, Dr. Denis Bećirović, for the review of the constitutionality of the Law on Amendments to the Law on the Use of the Flag, Coat of Arms and Anthem in the Bosnian and Herzegovina Entity of RS, made an extremely important decision by which it accepted the applicant’s request for the adoption of a temporary measure.
The decision of the Constitutional Court of Bosnia and Herzegovina is a legal victory for all citizens of Bosnia and Herzegovina who want peace, security and a state governed by the rule of law.
The Member of the Presidency of BiH will continue his persistent and well-argued fight for the protection of the state of Bosnia and Herzegovina, even on the legal front.
The decision of the Constitutional Court of BiH shall enter into force immediately and shall be legally effective from the date of entry into force of the aforementioned law, i.e. from 1 February 2025 until the adoption of the final decision of the Constitutional Court of BiH on the submitted request. In this specific case, the Constitutional Court of BiH notes that the Law on Amendments to the Law on the Use of the Flag, Coat of Arms and Anthem allows, in addition to displaying the coat of arms and flag of the RS as an entity and performing the RS anthem, to display coats of arms and flags and perform the anthems of foreign states.
The application of the Law on Amendments to the Law on the Use of the Flag, Coat of Arms and Anthem implies that, in addition to the RS symbols, symbols of foreign states may also be displayed in all public institutions of the Republic of Srpska. The above implies the conclusion that public authorities in the Republic of Srpska may, in accordance with the Law on Amendments to the Law on the Use of the Flag, Coat of Arms and Anthem, take concrete steps to place and display symbols of foreign states in all public institutions in addition to the existing symbols of the RS entities. Also, according to this law, symbols of foreign states, in addition to the RS coat of arms, may also be used on seals and stamps used by public authorities in the Republic of Srpska, etc.
The Constitutional Court of BiH notes that regulations relating to the use of symbols represent one of the most important areas of regulation in every state because symbols are an expression of the sovereignty, identity and constitutional order of a particular state or part of it, and they are simultaneously used in international relations.
